This page (together with the documents referred to on it) tells you the terms and conditions on which we hire vehicles to you as listed on our website www.glamourcars4hire.com. Please read these terms and conditions carefully before proceeding with any hire. You should understand that by hiring any of our vehicles you agree to be bound by these terms and conditions.
You should print a copy of these terms and conditions for your future reference.
Please understand that if you refuse to accept these terms and conditions, you will not be able to hire any cars from our website.
Information about us
www.glamourcars4hire.com is a website operated by Glamour Cars Limited (we/us). We are registered in England and Wales under company number 05938634. Our registered office is at 18, Stanley Green Crescent, Poole, Dorset, BH15 3TH.
How the contract is formed between you and us
After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to hire a vehicle. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms the hire. The contract between us (Contract) will only be formed when we send the e-mail confirmation.
Prices
The price of hire of our vehicles is as quoted on our website from time to time, except in cases of obvious error. Prices are exclusive of theft protection, delivery and collection and VAT (which will be charged in addition). All prices include 100 miles per day. Excess mileage charges are subject to vehicle type. We also offer bulk miles which can be bought in addition. Please note that these can only be bought prior to the hire, please phone and ask for more information.
There is a booking fee of 25% of the hire cost for all vehicles which is non-refundable on cancellation, unless you give us more than 7 days notice in writing.
We reserve the right to ask for a deposit to be taken in relation to the hire of any vehicle. The deposit will be held against any money that you may owe us under the terms of this Contract.
Payment
We accept all major credit cards. Account facilities are available to UK companies on request. Long lease hire and other options are also available – please contact one of our rental agents for more information. Payment must be made in pounds sterling on the day on which the vehicle is ordered unless we agree otherwise in writing.
In the event you do not make any payment on the due date we may charge interest on the overdue amount at the rate of 4% per annum above HSBC base rate.
Age limits and licence requirements
All drivers must be over 25 years and under 70 years of age and must have held a full valid driving licence for at least two years. Driving licences must be presented at the time of hire. We will verify the details of drivers under the age of 30 which can take up to 2 days. Certain endorsements may not be accepted, please check when making your reservation.
Delivery and collection
We offer a mainland UK wide delivery and collection service for all our vehicles. This service is subject to an additional charge. All charges quoted for deliveries or collections are made during normal business hours. There is an additional charge for deliveries made outside these times.
Inspection of vehicles
You must complete and sign a damage check sheet prior to use of the vehicle and at the end of the hire of the vehicle. Once the vehicle has been returned to the rental premises, a final damage check will be undertaken by us. Should any damage be found upon inspection of the vehicle, you will be liable for any costs under condition 8.
We reserve the right to record images of the vehicle and each person who will be a driver of the vehicle during the hire period either by photographer or video or other similar device and by hiring the vehicle each person is deemed to consent to the images being taken.
Your Responsibilities
The vehicle must only be driven by you. Anyone driving the vehicle must have a full valid driving licence. Should you wish to add any additional drivers to the hire, you will need to speak to one of our hire agents at time of rental. The charge for each additional driver is £100 per day. His/her license must be shown at the time of hire.
Neither you nor any other authorised driver may:
- use the vehicle for hire or reward;
- use the vehicle on non-paved roads or off road;
- smoke in the vehicle;
- use the vehicle to transport animals;
- use the vehicle for any illegal purpose;
- use the vehicle for towing, racing, pace-making, testing the vehicle's reliability and speed or teaching someone to drive;
- use the vehicle while under the influence of alcohol or drugs or if you are medically unfit to drive;
- overload the vehicle beyond the manufacturer’s maximum weight recommendations;
- drive the vehicle outside the mainland UK, unless we have given you written permission; or
- use the vehicle on any race track, airfield or otherwise on roads that are not part of the public highway.
You must look after the vehicle, any accessories and the keys to the vehicle. You must always lock the vehicle when you are not using it, and use any security device fitted to or supplied with the vehicle. You must make sure that you use the correct fuel.
You must not sell, rent or dispose of the vehicle or any of its parts. You must not give anyone any legal rights over the vehicle.
You must not let anyone work on the vehicle without our permission. If we do give you permission, we will only give you a refund if you have a receipt for the work.
You must let us know as soon as you become aware of a fault in the vehicle.
You must return the vehicle in the same condition it was in at the start of the hire period.
Before you bring back the vehicle you must check that you have not left any personal belongings in the vehicle.
Damage to a vehicle
You will be liable for any damage to a vehicle and the costs of repair. In the event that there is damage to a vehicle, we will send it to the recommended repairer to rectify the damage to the vehicle. You will have to pay these costs.
We will invoice you directly for the costs of repair. These will include the cost of the damage repair as well as administration charges, spare parts and labour costs. You must pay the costs of repair within 14 days of receipt of our invoice.
Our responsibilities
We have maintained the vehicle to at least the hirer’s recommended standard. The vehicle is roadworthy and suitable for renting at the start of the hire period. If you are not renting the vehicle for business purposes, we are responsible for loss caused by:
- the vehicle not being of the quality that you would be entitled to expect from a hire vehicle;
- the vehicle not being fit to drive; or
- us not having the legal right to rent out the vehicle.
In the event of a breakdown we will use our reasonable endeavours to supply you with an alternative vehicle.
Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the hire charge. We shall not be liable to you, whether in contract, tort (including negligence) or restitution, or for breach of statutory duty or misrepresentation, or otherwise, for any:
- loss of income or revenue;
- loss of business;
- loss of profits or contracts;
- loss of anticipated savings;
- loss of data;
- waste of management or office time however arising and whether caused by tort (including negligence), breach of contract or otherwise.
This does not include or limit in any way our liability:
- for death or personal injury caused by our negligence;
- under section 2(3) of the Consumer Protection Act 1987;
- for fraud or fraudulent misrepresentation;
- for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
Availability of vehicles
Please note that every effort will be made to provide the vehicle chosen. However, we reserve the right to offer the nearest vehicle model as an alternative.
Hire period
You will have the vehicle for the hire period as agreed. If you wish to extend the hire period, you must advise the hire agent. Failure to do this may result in the withdrawal of insurance cover. We will charge you for every day or part day you have the vehicle after you should have returned it to us.
Additional hours
All hires are taken on a 24-hour basis. Vehicles returned later than the time stated on the rental agreement will be charged accordingly. If you do not bring the vehicle back on time you are breaking these terms and conditions. We can charge you for every day or part day you have the vehicle after you should have returned it to us. Until we get the vehicle back we will charge you the daily rate.
Petrol
The cost of petrol/diesel is not included in the rates. Vehicles are supplied with an adequate amount of petrol and should be returned with a similar quantity. If this is not the case, any reimbursement for petrol will be charged at the pump price plus a £10 administration charge. Please note all cars at the moment take super unleaded fuel only.
Traffic violations
You are liable for all penalties incurred during the hire period.
We reserve the right to levy an administration charge of £30 + VAT for the processing of any such penalty.
If we are notified that the vehicle is being used at speeds in excess of the legal speed limit we may bring the hire to an end straight away and you must return the vehicle to us immediately upon us bringing the hire to an end and you will not be entitled to a refund for any period from termination to the end of the prepaid hire period.
Property
We are only responsible for loss or damage to property left in the vehicle if the loss or damage results from our negligence or a breach of contract.
Right to vary these Terms and Conditions
We reserve the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
Force Majeure events
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract or from carrying on its business by acts, events, omissions or accidents beyond its reasonable control, including (without limitation) strikes, lock-outs or other industrial disputes (whether involving our workforce or that of any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.
Transfer of obligations
You may not transfer, assign, charge or otherwise dispose of a hire agreement, or any of your rights or obligations arising under it, without our prior written consent.
We may transfer, assign, charge, sub-contract or otherwise dispose of a rental agreement or any of our rights or obligations arising under it, at any time during the term of that rental agreement.
Ending the rental agreement
If you are a consumer we will end this agreement straight away if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may end this agreement if you do not comply with the requirements of the hire contract.
If you are a company, we will end this agreement straight away if:
- you go into liquidation/become bankrupt;
- you call a meeting of creditors;
- we find out that your goods have been taken away from you until you pay off your debts; or
- you do not comply with any of the conditions of this contract.
If we end the hire contract it will not affect our right to receive any money we are owed under the conditions of it. We can also claim reasonable costs from you if you do not meet the main requirements of this agreement. We can repossess the vehicle (and charge you a reasonable amount) without using unreasonable force or causing damage.
Data protection
You agree that we may use any information you have given us to carry out our own market research. If you break the contract we can give this information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. We can also give this information to the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose shown in the Data Protection Act 1998.
Severability
If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
Governing law
Contracts for the hire of any vehicles will be governed by English law. Any dispute arising from, or related to, such hire contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales. |
